General terms of sale

The Company MAJA based in San Martino di Lupari (PD) in via Leonardo da Vinci, 40 [VAT code: 04166000283], produces, sells and distributes white goods and metallic components, in addition to various accessories of the PEPEGRILL brand, via its e-commerce page on the web site www.pepegrill.it.

The general terms of sale apply to any order submitted on the web site www.pepegrill.com.

The Customer declares that he/she has examined all the indications provided during the purchasing process and that he/she fully accepts the general terms of sale and payment; he/she also declares to be over the age of 18, and has the legal capacity and the capacity to stipulate a valid, effective contract of purchase and sale.

MAJA sas may modify, at any time and without notice, the content of the GENERAL TERMS referred to herein; these modifications will become effective from the date of publication on the web site.

Legal notices

A Customer who purchases products distributed by MAJA sas accepts that any dispute and relationship deriving from this purchase is subject to Italian Law.

Product characteristics

The Customer will purchase the product, the characteristics of which are illustrated in the relevant descriptive and technical sections, at the price indicated therein, plus any applicable shipping costs indicated on the web site. The images of the product are for illustration purposes only: depending on the software or other computer instruments used by the Customer to connect to our web site, the shade of colour of the product may not be shown properly.

The Seller declines any liability in relation to problems incurred to the Customer deriving from the use of the web site and the technology used.

Purchasing process

Before submitting a purchase order, the Customer is obliged to accurately read these general terms of sale. By submitting a purchase order, the Customer acknowledges his/her familiarity with and acceptance of these terms. The “click to confirm” constitutes an electronic signature, which is has the same value of a handwritten signature between the parties.

Purchases can be made on the web site www.pepegrill.com through a simple guided procedure.

A receipt of the Customer's proposal of purchase will be confirmed by www.pepegrill.it by means of an automated reply, which will be sent to the Customer's e-mail address within 48 hours of receipt. This automated email will merely confirm the correct receipt of the proposal and the confirmation message will contain the Order Number, which must be indicated in all further communications with MAJA sas. Orders will be accepted and processed within one working week (Mon/Fri), excluding bank holidays.

Each contract of sale stipulated between MAJA sas and the Customer will be deemed to have been concluded when the order has been accepted by MAJA sas. The latter reserves the right to decline an order, and thus not to finalise the contract of sale, if there is an insufficient guarantee of solvency, if the orders submitted are incomplete or incorrect or if the products are no longer available. In the cases listed above, the Seller will promptly inform the Customer by e-mail that it has not confirmed the order, and that the contract has not been concluded, specifying the reasons.

Prices and delivery times/methods

All prices are inclusive of VAT and are clearly indicated in the individual product sheets.

The prices indicated are subject to variation, at any time and without notice, except in the case of orders in the process of being accepted, or any which have already been accepted by MAJA sas, in which case the terms of sale in force at the time of order submission will apply.

The items purchased will become available for shipment within 48 hours of receipt of the order and payment.

The products purchased will be delivered only to the street address specified by the Customer in the order form. When the products are handed over to the Courier, the Customer will receive an e-mail confirming shipment, indicated the tracking number that the Customer can use to check the shipping status.

Deliveries are made from Monday to Friday during normal business hours, excluding national or bank holidays.

At the time of delivery, the Customer must check the contents, conformity and condition of the products. Should the package be serious damaged to presume consequent damage to the contents, the Customer may refuse delivery of the merchandise, indicating on the transport documents of the courier “I REFUSE THE MERCHANDISE DUE TO DAMAGED PACKAGING”.

Any complaints must in any case be sent formally to customer@pepegrill.com within no more than 72 hours of receipt of delivery, indicating the order number and the reason for complaint, and attaching relevant photographs of the damage.

After 72 hours of receipt of delivery, the merchandise will be deemed to have been fully accepted by the Customer and no complaints may be made to the Seller.

Payments

Payment of the purchased products may be made using one of the following three methods:

In the event of non-availability of a product:

The data indicated in the individual product sheets are not updated in real time, which means that in rare cases a product ordered may in reality be unavailable.

The Customer will be notified, within 48 hours of receipt of the order (excluding bank holidays), of the exact delivery date.

If an item is unavailable, the Customer will be sent an e-mail proposing delivery of a similar item.

MAJA sas will in no case be held responsible for any delays in delivery

Rights of withdrawal

If the Customer is unsatisfied with a purchase, for any reason, he/she has the right to withdraw from the contract stipulated, without penalty and without having to specify the reason, within 10 working days of receipt of the merchandise. To exercise his/her right of withdrawal, the Customer must send a written message by registered letter with return receipt, to the following address: PEPEGRILL Customer service, c/o MAJA sas, via Leonardo da Vinci, San Martino di Lupari (PD). In this message, the Customer must indicate his/her IBAN and any other details necessary in order to reimburse the amount due. In the event of a return of goods, the shipping charges will be at the Customer's expense. The products returned must be intact and in their original packaging. If the Seller detects any damage and/or breakages in the merchandise returned by the Customer, or if it is found that the right to withdrawal has been exercised beyond the term of 10 working days of receipt of the merchandise, this right may not be exercised, the Seller will not reimburse the purchase price and will place the product at the disposal of the Customer, who will be responsible for picking it up at his/her own expense. If all the conditions are met for valid withdrawal from contract and the merchandise is returned intact, the Seller will reimburse the purchase price to the Customer by bank transfer, within 30 working days of receipt of the merchandise.

Liability

In unforeseeable and fully involuntary events due to force majeure, such as: accidents, explosions, fire, riots, strikes and/or lockouts, earthquakes, floods, damage to IT systems, system failures and other similar events, MAJA sas will not accept any liability for any impediments to execution of the contract, in full or in part, within the agreed times. Nor will it be liable for any damage, loss and/or costs deriving from the above events, and the consumer will have the right only to reimbursement of the price paid. Furthermore, MAJA sas will not be liable for any fraudulent, unlawful use of credit cards, cheques and other methods of payment, since it has no opportunity to find out the consumer's credit card number during any stage of the purchasing process. This data is in fact always transmitted directly to the Bank managing the service via a secure connection.

Liability of the user

The Company MAJA sas declines any liability for any damage/deterioration to the products, deriving from improper use and a failure to follow the indications that are clearly provided in the manuals of use supplied together with the products sold.

Even in the case of direct or indirect damaged caused by downloading images, or elements present on the web site www.pepegrill.it, computer viruses, malfunctions and errors, that might obstacle continuity of access to the web site, or cause difficulties in web searches, MAJA sas can never be held liable.

Applicable law and place of jurisdiction

This contract will, in any case, be deemed to have been concluded in Italy: it comes under the jurisdiction of Italy and is governed by Italian law. Any dispute relating to the stipulation, interpretation, execution or termination of this contract will be referred to the exclusive jurisdiction of the court of Padua.
